H1B premium processing is suspended until Feb 19, 2019 for H1B extension, transfer and amendments at California and Nebraska service centers resulting in increased delays.

Raise USCIS SR – Outside Normal Processing Time

If your ‘case received date’ is before the date (worst case) mentioned above, you should raise a service request with USCIS to check why your case has been delayed. This could mean your case is taking longer than other similar cases and may be stuck in administrative processing.

H1B Grace Period – 60 days

If your are laid off by H1B employer, you have 60 days grace to find another H1B sponsor. Does not matter how much processing time an H1B transfer takes place, you can start working immediately based on receipt on or before 60th day.

H1B Visa Approved Status – Admin Processing Time – US Embassy

Do not worry. It takes 7-10 calendar days to process Admin processing cases after visa is approved by visa officer.

    I see that best case approval remain at Jan 15 for California service center for past 10 days or so, so there no approvals coming in form that center after Jan 15th ?

    • That probably means either users have not shared their new data or there are no new approvals from California service center.

    Do you think premium processing will start anytime soon for remaining applications? By April 1, there will be new applications so if USCIS wants to clear the old applications by then? Any thoughts,

    Hello Anil,

    My extension is pending with Employer A and lets say if it gets rejected and my i-94 is expired and i had to move back to India.

    and if i want to apply for new cap exempt petition with Employer B can I do it even if the employer A revokes the the original H1b?. Please let me know

    My case is filed with Nebraska center on 25th sep 2018 and I am yet to get a decision. As per case status check in USCIS site they are processing sep 26th date as of now. Is it something that i need to be worried about or is it a normal scenario?

    Also tried to raise an SR (outside normal processing time) but it is not allowing to place the request.

    Hi Anil,
    I moved to new employer with receipt on Oct 2018 and my case was filed to California center when I checked the status it was moved to Nebraska on January 14th 2019. Does Nebraska consider my original filed date or received date (Jan 14th) to process my case?

    I resigned from Employer A and applied transfer my petition to Employer B and status is pending in California service center. Employer A revoked the petition and I94 is expired already.

    1. If suppose Employer B transfer is denied then with in how many days I have to move out of US?
    2. Even I am not in USA, my understanding is that Employer B can re-apply the transfer and I can enter the US after the stamping. Could you confirm this?
    3. If suppose, Employer C file an H1B transfer and it is approved while Employer B’s transfer denied then can I move to Employer C without leaving USA?

    Hi Anil, My h1b extension plus amendment is pending in nebraska. My receipt date is Sep14th, 2018. It is applied in california and moved to nebraska on dec 18th. when can I expect ? My hr told me to wait for 10 more days and then upgrade to premium. when can I expect result? Can I ask employer to raise Service request.
