I-130 Sponsor Family for a Green Card

U.S. citizens can sponsor following family members using Form I-130:

  • Natural parents, step-parents and adoptive parents
  • Unmarried sons and daughters under the age of 21
  • Husbands and wives
  • Brothers and sisters, adopted siblings, step-siblings and half siblings
  • Married children or children over the age of 21

Family Green Processing time – Regular Application

How long does it take for I130 to get approved for spouse is based on current processing time mentioned above at the USCIS service center.

Raise USCIS Case Service Request – Outside Normal Processing Time

If your ‘case received date’ is before the date (worst case) mentioned above, you should raise a service request with USCIS to check why your case has been delayed. This could mean your case is taking longer than other similar cases and may be stuck in administrative processing.

Next step after I-130 is filed?

A Green card priority date (receipt date) is assigned by National Visa Center (NVC) on USCIS-approved i-130.

A wait list is created with priority date cut-off and USCIS announces current cut-off dates in monthly Visa Bulletin.

i485 Green Card Adjustment of Status Processing Time

Family member is inside the U.S.

If your family member is inside the U.S. at the time their priority date becomes current, they need to file Form I-485 Green Card application to change their status to permanent resident (green card).

Family member is Outside the U.S.

If your family member is outside of the U.S. at the time of priority date getting current, the NVC will send your petition and their visa number to the family members’ local U.S. consulate or embassy, which will contact the family member to come in and complete visa processing.

    My wife is in usa since 2016 LPR (perment green card holder) she submite my file for spouse after marriage in india i130 on 01-Aug-17 in california center. we received accepted letter from uscis on 03-Aug-17.
    So when I received my approval letter and after approval how much take time nvs for Visa call and everything

      The first step is to get I-130 approval. You can expect your approval by June 2019 end for your application filed at California service center.
      Then, your you will need to check your priority date in monthly visa bulletin.
      Once you PD date is current in visa bulletin, NVC will call you for Green card interview.

  2. My husband’s I-130 (Consular proceeding) is approved. We already submitted the I-601A (unlawful presence waiver) and received a letter to do his fingerprints. I am a US citizen, his fingerprints are done as requested by the letter. How long until we hear anything from anyone? What’s next? We do have a lawyer.

      Please check with your lawyer on how much more time will it take. My estimation is that you would get it within 2-3 months.

      At this time, US citizen filing for brother or sister is taking 9.5 years to get approval for I-130 application at California service center.


  4. My case was filed by the law firm and sent to USCIS from early December, 2018. However, today, March, 8th, 2019, I never get any receipt I797C from USICS. What is wrong with my case ? Please tell me. Thanks

      Ask your attorney if they have received your i797C. USCIS will mail it to attorney if they have given their address as mailing address.

      If not, then ask your attorney to raise a service request with USCIS and re-send the receipt number.

  7. Hi Admin, My Spouse (Green card holder) filled I-130 in feb 2019, received receipt number starting with WACXXXXXXX. How long does it takes to get approval, am i eligible to get EAD after 130 approval…… what will be next steps till GC ..very much appreciated your response Thank you.

      It is currently taking about 21 months to get I-130 approval for Green card holder spouse to get approval.

      You can expect your approval by Dec 2020.

      The EAD depends on lot of other factors and it is out of scope of this page.
      You can ask your EAD questions in our forum separately and i will answer there for your understanding.

      You cannot choose the USCIS service center yourself.

      USCIS will decide it based on your address and application type.
