i140 Withdrawn vs Revoke

Your i140 stays valid if it has not been withdrawn by employer in 180 days after its approval.

USCIS only revokes i140 if they find any fraud or mis-representation by your employer. You cannot use the i140 if it has been revoked.

Employer may request the i140 withdrawal even after 180 days. Do not worry if the USCIS case status shows as ‘withdrawn’ online.

i140 Withdrawal is safe but revoke makes i140 un-usable for future.

H1B Transfer with Withdrawn i140

You can use withdrawn i140 to port your Green date to new employer by filing a new PERM and i140.

Use i140  extend your H1B stay in US after 6 year. You can change employer using i140 and file H1B transfer multiple times as long as your Green card priority date is not current.

Employer not sharing i140 details?

You can request your i140 details from USCIS using FOIA request if your employer is not sharing i140 with you.

    Hello Anil, although the table shows that the most rapidly approved case of EB-2 NIW visa was introduced on March 25, 2019, it has been in effect since December 17, the date on which I first entered your page (very informative for others). I assume that until now there has not been a case approved more quickly than that (8 months and 26 days), but I wanted to ask you if you do not know which month of the year 2019 the reviews of this type of visa are going to?     Hi Anil,

    My employer just told me that my PERM was approved.

    1) Can we we file i140, H4 EAD all together in premium processing? What is the best way to get H4 EAD faster?
    2) Can we change category from EB2 to EB3? I saw EB3 is moving faster than EB2 (I know it might be few years from now to check this)

      You need i140 approval to file H4 EAD. H4 EAD does not have any premium available as a standalone application.

      You can change category from EB2 to EB3.
      But, it is too early to make that change. You probably have at-least 100+ years of waiting if you are from India. So, just relax and enjoy.

    When I checked the processing time, it has increased up to 13 months.

    Hi Anil,

    I was hoping you could have some answers regarding EB-2 NIW. My priority date is Aug 3, 2018 and still pending. My case is in the Texas Center but it was already transferred twice (back and forth) to the NBC.

    The point is that, since it was received, the processing times have kept increasing over and over (from around 3-5 months to 10-13), so it looks like cases have not been approved since April, 2018. Do you have any insight on this?

    Is there any estimate on when can I heard back from USCIS (with a decision)?

    I see EB2 – Last Approval Date is on 07 Feb 2019 for period of time. May I know when is the next update on i-140 cases.

    a) My case was filed on mid of April 2019 (SRC ***) in regular mode and when can i expect an update on my case.
    b) visa extension using i-140 approval, whether i should have at least 3 months for an max-out ?

      Attorneys recommend to leave 60 days in your max out time but i have seen people leaving US with 1 day left in total 6 year quota too.

      Your attorney probably just wants to verify the originals. Nobody will give or need your originals.
      Only a copy is required.

      How will you get new original experience letters if they lose them or never return to you?

      It means what it says. A receipt number has been generated for your application and sent to you for tracking.

    Hi Anil,

    My I 140 got filed on Oct 30- 2018 in texas location and its been more than 6 months and i am yet to get reply. In USCIS website current date to raise SR to check the status on I 140 case is Nov-3-2018.

    Even though SR eligbility date crossed my I-140 filing date, i didnt get any update. My employer didnt share me the case number but i am sure that they are not lying as they too badly want my case to be approved sooner. Any thoughts on why there are no response on my case?. is there chance for RFE since it crossed the SR date?. I am very much tensed. Please advise

    Also my colleagues whose I 140 got filed on Nov-5-2018,Nov-30-2018, Dec-20-2018 got approved. Just wondering what is happening in my case

      There is nothing to worry. You are eligible to call USCIS and raise a service request. Raise the request and you will know the reason for delay.

      No need to take tension and increase your blood pressure. You will be fine and case will be approved. Many times, cases are just pending with no reason.

And also, I heard this green card is EB-3 category. So I used to check the estimated dates of “skilled worker(E31)”. However, today, I found “Schedule A nurses” and I think that’s right thing for me…? I googled it but still am confused. Which one can I check for my case?

          Raise SR dates are controlled and shared by USCIS. They publish these dates monthly based on their own data analysis.

            USCIS has of course gone bonkers! Nebraska I-140 raise SR dates first jumped to 5-Oct overnight last week and now has retrogressed again to May etc. today. One more proof that the whole system is absolutely broken!

    Hi Anil,

    I got my 1st h1b for 1 year. I applied for extension and got approved till sep -2020(2nd h1b) . So, now I applied 2 times of h1b. (total duration 1st +2nd- 2 year 10 months). If I apply 3rd time, do I need to get i140 approved by that time. Is it 6 year limit or 2 times? I am confused.My company is going to start perm process next week. Please advice me on it.

      The H1B limit is is 6 year and not number of times.

    Hi Anil,

    I am following up this page last three months since my I-140 is in pending status since from Dec 3rd’2018 (Nebraska), I noticed that Nebraska advanced skills (EB2) processing application date progress almost went end of Aug’2018 and but it went back to 27th July few days ago (Mid of last week). do you have any idea why this was happened?

    Also i noticed that Nebraska they are increasing day by day the processing dates everyday, even with the weekends, but in their site it says that monthly they update the data ? so i confused that processing date what i am seeing is true or not ?, when is the best time to see the actual true processing time.

    This site only had the processing period (between dates) , i understood that it is best case receipt date approved, Can you explain that process what USCIS follows the procedure to pick the regular processing cases?

      USCIS updates their dates daily as well as monthly. In their monthly update, they usually move the ‘Raise Service request’ date backwards.

          Yes, you can consider that dates between (given above) as the time period for which USCIS is currently processing applications.

    I have approved i140 and currently on H-1B in my 5th year. Can I leave the US and come back later through a different employer (not from the same employer with whom I have my current H-1B and I140 approved) once my date is current?

    For Nebraska EB3 best case approval,date is shown as Dec 22 2018. It was Saturday. Does it mean uscis is working on
    Saturdays for processing applications?

      It means that the user who shared his case details probably entered the wrong case receipt date in our system.
      All the data is user driven.

      You can use the ‘add and compare case’ to see the case numbers and their receipt dates.
      Our service tries to verify the case status for selected cases and it we have verified, the small “verified” check mark shows up against the case.

    Is there a way to subscribe to that user gets a notification when there is a change in the queue of interest. For example, say a users has E11 case in Texas center. Is there a way for user to get email notification as and when there is any movement in E11 texas center queue.

    Hi Anil,

    when i applied for H1b Extension on Oct-2018 it got approved and validate up to 31-March-2019 but I-94 is valid up to 10-April-2019.
    my 6 years max date is 21 April . my attorney is filing my 140 this week and once it’s approved they will file again visa extension.
    my question is can i stay up to 1-April as I-94 valid if my next visa extension is not file before 31-March.

      Your H1B extension should be filed before 31 March to be on safe side.
      You can stay in US up-to your i94 expiry date legally.

    I filed my EB3 i140 downgrade on Jan and its in Nebraska service center.
    Looks like its now 2+ month for approval. Does the above statistics show from Minimum time frame to maximum time frame.
    ie Even if one case appoved in 10 days, that would show as min 10 days.

          In the last 3-4 visa bulletins, EB3 is moving faster than EB2. But, that does not mean that the trend will continue.
          At some point, EB2 will move faster than EB3 again as people will keep jumping from one lane to other.

    For Nebraska, in “Advanced degree or exceptional ability” category Raise SR date is 5 August 2018
    Then how come processing time range is 12 may ,2018 to 13 July 2018 ?

    Hi Anil,

    My employer started the GC process last year and my H1B max out date including recaptured days was Dec 20. There was a delay in getting the PW so by August I realized the I will not get the PERM and I140 before max out date so I left US by mid October before my employer filing PERM and working for the same employer now in India.

    1. I received the ETA 9089 form from the attorney for review – Is there anything particular about filing PERM while staying in USA and while out of country, like Form type or any specific fields which requires different process?

        Sorry for the confusion. There are two things:

        1. Just want to know whether anything different process wise/form wise while filing for PERM for candidate who is within or outside USA.
        2. I looked at form provided by my attorney, in that in section
        2.a J. My residence address is mentioned – Should I give my non-US address here?
        2.b J.8 Class admission: H1B – Should we change this response
        2.c J.19 I94: My last I94 number is mentioned here – Should we need to leave the field blank. If I leave it as it is will it be a problem?

          You should talk to your attorney to understand what should be filled if you are outside USA.
          Do not fill anything that is currently NOT true like your address and Class of admission.
          You do not reside at the US address at this time and neither are you in US with H1B status.

          Your i94 is also NOT valid as you are out of USA.

          You can file PERM if you are outside USA. I do not have have knowledge about PERM form filing as it is done by attorney.

      Your question is not clear about whose receipt notice you are looking for: H1B or I-140?.
      I140 application does not need H1B receipt notice.

    Can you help me understand or predict my case, I see you are a real expert here:
    PD: 19-Jul-2018
    Concurrent filing (I-140 and I-485) Nebraska office
    Eb1C – ROW (Israel citizen born in Germany)
    14-Sep-2018 – Fingerprint review completed
    Sep-2018 – EAD and Advanced parole received for all the family (me, wife and 2 kids)

    Can you help me understand how to predict my I140 to be approved and then my 485?
    Asking because I want to stop watching forums everyday – makes it frustrating 🙂

                As mentioned above, my PD is July-2018, EB1C ROW, and my 140 still in the status “Case was received”,
                In many forums I can see that July filers are getting approved (even some Aug filers).
                What do you think? should I start being worried? what is the rate of approvals for Nebraska? are they catching up?
                Some big picture details on the processing would be much appreciated.

    I downgraded from EB2 to EB3 with normal processing as no original labor attached. How long downgrade process would take compare to normal I-140 which has original labor?
