PERM processing time is 3 months. PWD approval is taking 3 months.

PERM auditing is done for 30% of cases by requesting job advertisement and employer documents. DOl also conducts supervised recruitment to find fraud. Audit cases are taking 6 months for approval.

PERM is first step in US green card process. PWD and PERM approval are required for H1B (EB2, EB3) and L work visas applicants based on their ETA Form 9089 filing with DOL.

USCIS does not process PERM.

File H1B 7th year extension, PERM pending > 365 days

How long does PERM approval process can take in not in your hand but you can file H1B 7th year extension (after completing 6 year quota) with PERM pending > 365 days including Audit time.

Experience letter for PERM – Skill Letter

Use PERM experience letter sample to get skills listed on old employer’s letter head as an employment verification. This may be needed to prove your skills for the job description that is relevant for your PERM application, if your case is selected for PERM Auditing. The letter also explains how to write job description for PERM.

Normally, 30% of PERM applications are selected randomly for Audit.

PERM in H1B 6th year – Can H1B be extended?

You cannot apply for H1B 7th year extension unless your PERM gets approved before your 6th year ends if you apply PERM during 6th year. PERM has to be either approved or pending (waiting) for more than 365 days on the last day of H1B 6th year.

As a solution to this problem, attorney’s suggest to re-capture vacation time spent outside USA and extend your 6th year end date.

Premium Processing

There is no premium processing available for PERM application. i140 application has premium and can be used to speed up filing 7th year H1B extension if you are near your max out time.

PERM Approval Delayed

If your application was filed more than 3 months prior to the date posted (raise SR) above, you may contact DOL Helpdesk for a status on the application at plc.atlanta@dol.gov.

    I’m confused by your tracking system. I have an audit case ongoing with a prior date of 11/12/19 and have not heard anything yet. How accurate are your dates shown and updated several times a date. Are they from the current day (real time)? If so, how are updates occurring on weekends (Saturday and Sunday) when the Labor Dept isn’t working?

    My H1B visa 6Years max timeout is in October 2019 and my employer has applied for perm on April 1st,2019.

    When can I expect the approval?

    Once perm gets approved ,My employer is ready to apply for I-140 in premium.

    Do you think I can make out without any hassles for the visa extension?

            I don’t see anything wrong with Shankar Prasad’s Question. Its seems logical to ask why do you estimate March end when DOL website show cases of Nov 2nd and 3rd being approved.

              I never said that anything is wrong with questioning but how can i explain my estimation?
              I estimate based on current data that you also see and is available publicly.

              If you believe that my estimation makes sense, you ask for it.
              If you think it not useful, then just ignore it.

              I apologize if my statement sounded harsh.

              My only point is that I am estimating based on daily data that i see and is available publicly.
              I am giving answer to each and every question asked on am22tech.com and truvisa.com

              I cannot really explain why I estimated a different date to earlier question 2 days ago every-time. Its difficult to keep explaining the same thing over and over again as people tend to just pick one response that they like.
              Users generally do not go through all other comments/answers that may have an explanation for why the estimate changed.

    Hi Anil,

    Can you explain me how does your processing dates goes back and forth every 3 hours? You had Nov 15 till this morning and now you have Nov 11. Does that mean they stop working on Nov 15 application and focusing on application up to Nov 11?

      The data above is collected from various forums and the details shared by users there and they sometimes share the wrong data. Our service tries to find the correct data and matches up with other forums and then tries to give the best estimate.

      The bad data (spammed) by users is deleted and hence the dates move back sometimes.
      The service is still in development and is learning how to weed out bad and spamming data shared by users.

    My company will file H1b extension with level 1 wage. If we get an RFE, can the company readjust to level 2 if they agree to?

      Who is ‘they’ here? USCIS or your company?

      You cannot change the level of wage later as per my information just to please USCIS. It is better you file with wage level 2 if that’s the plan to improve your chances of approval.

    My PD date is 02/01/19 but perm application number provided by lawyer is A-18339-XXXX. seems he started perm online application on 6th dec.
    In this should i expect to get approval by next month as currently Nov month is going on or is it something they consider filing date/PD date for processing Perm application.

      I can only estimate based on your PD date (1 Feb 2019?) and you can expect your PERM approval by April 2019 end.

          If you can get your PERM approved and file i140 in premium, then it seems possible that you can file H1B 7th year extension before Oct 2019.
