PERM (first step in US green card process) approval processing timeline are for H1B (EB2, EB3) and L work visas applicants based on their ETA Form 9089 filing with DOL.

USCIS does not process PERM.

PERM applied in H1B 6th year. Can H1B be extended?

You cannot apply for H1B 7th year extension unless your PERM gets approved before your 6th year ends if you apply PERM during 6th year. PERM has to be either approved or pending (waiting) for more than 365 days on the last day of H1B 6th year.

As a solution to this problem, attorney’s suggest to re-capture vacation time spent outside USA and extend your 6th year end date.

    My PWR is just filed on Marc 11, 2019 and my employer is planning to start recruitment phase parallel as well. My 6th year ends on NOV 30, 2019. Could you please let me know if my I-140 will be approved by then. I am concerned regarding PWR timeline, i didnt anticipate it taking this long.


    • You are on edge and you might be able to get i140 approval if filed in premium by Oct 2019 end. Its pretty close.

    My PERM application was applied on OCT 25 in EB2. Still i have not received any confirmation from attorney.
    1. Can the delay be due to Govt. Shutdown.

      You should have received your PERM approval by now. Did you check with your attorney if they have received any Audit request or not?

    My Max out date is Sept 13 2019 and PERM filed on Mar 5th.How long does it take to get my PERM and I140 approved.Do I have chances(enough time) to go for 7th year extension?In case if it gets delayed when(2 months or 3 months before maxout?) should I travel back to India to file extension from India?

    Hello Anil,

    My H1B Max out’s on 2/2020, My employer is starting recruitment next week which would be for approximately for 75 Days. My employer is also waiting for wage determination which was filed on 12/14/2018.

    Can you please suggest
    If my employer files my perm by July 2019, Will that time be enough to get PERM Approval, 140 and apply for 7th Year H1B before 2/2020.

      PERM approval is currently taking abut 4 months, so you should be able to file H1B extension if you file i140 in premium.


  5. Hi Anil,

    My H1 will max out on 9/23 this year. My employer is applying for my PERM on 3/26(PWD and recruitment are done) but not using the electronic system but the paper application by mail. Do I have enough time to get the PERM and I 140 and apply for extension. We are also expecting a baby in Oct, so leaving the country after June is not an option. I qualify for H4 EAD through my spouse. But his extension is coming up in June(current H1 expires in Nov 2019). I am confused as to what course of action to take now with all the talk of EAD going away. Any suggestions? I may have 30 days to recapture.

      You should be able to get PERM approved in about 4 months and then file i140 in premium.


  6. Hi Anil- got PWD last week and employer is starting recruitment now. In 6th year and visa expiring 8/22 with 30 days outside for recapture. Any chance that perm once filed might get processed quickly or should I make plans to leave the country? Any risk of getting visa stamped if leaving country now to allow for more recapture time?

      You are on edge. You might just be able to complete the PERM but you will still need to file i140 in premium to make it through 8/22.


      • Yes prepared to do premium processing but they say recruitment is mandatory 60 days, so PERM filing won’t be for 2 more months. Do you think the PERM application will get approved with sufficient time to file i140 in premium?

          As I already said, you are on the edge. You may or may not get PERM approval within time. Your employer is probably just playing as late as they can to keep you hanging with them.


          • Hi Anil , mine is ad/recruitement state from 2/6 with job order placed in SWA. , two sunday ads placed and 2 recruitment steps placed. When i enquired my immigration if we can file considering the quiet period atleast by May 1st. they said as below. Can you explain what does that mean.
            “Per DOL rules, you need to remain removed during the recruitment phase of the PERM application. That process is currently ongoing and we will let you know once it is completed.”
            Note : My max out is June 2nd week considering all my recapture . just trying to avoid the stay outside US short.

              I do not know what your immigration team mean by that statement. You should ask them to explain.


            • During recruitement period you should not be involved. Any communication you have with the immigration team can be considered as you try to influence the process. So it is advised you do not contact the immigration team on any matter until the recruitement is complete

      You can expect your PERM approval by July 2019 1st week end. There is a case number assigned for PERM application but you can’t check status online for it. Only your employer can check the status.

    you mention perm clean cases time line nov to dec 13 but as per DOL site they havent yet started dec cases.
    have you got info about dec cases.
